OKTO Card Promo Offer Terms and Conditions
1. OKTO offers to the Romania OKTO.WALLET Users (“Users”) which are eligible as below noted the ability to issue an Okto Prepaid Visa Card (hereinafter “Okto Card”) without being charged the Order Fee and 1st Year Service Fee as these are included under the Okto Consumer Service Pricing (https://www.oktowallet.eu/services-pricing-consumer/#gbp).
2. The present terms are subject to the OKTO Consumer Terms and Conditions, the Card Consumer Terms and Conditions, OKTO KYC/AML Levels and Limits, and the OKTO Privacy Policy set forth on the OKTO Website (www.oktowallet.eu).
3. Taking part in the Okto Card Promo Offer constitutes acceptance of these Terms and Conditions. If you do not agree to these terms and conditions, please do not participate in the Okto Card Promo in any manner.
4. The Okto Card Promo Offer is provided by Sureswipe a company registered in Cyprus operating as a licensed e-money institution under the supervision of the Central Bank of Cyprus (authorization number 115.1.3.26) and approved to provide electronic money services under the freedom of provision of services within the EEA countries under the Electronic Money Directive in collaboration with its electronic money distributor OKTOPAY LIMITED, a based in Cyprus, 10 Mnasiadou and Strasikratous Street, P.C. 1065, Nicosia, Cyprus, with registration number HE400907 (collectively referred to as “OKTO”).
5. The participation in the Okto Card Promo Offer does not require the payment of any extra charge and pertains to the exemption of the Order Fee for Physical Prepaid Card (Order, Shipping, 1st Year Service Fee) amounting to 20 Lei or Order Fee for the Virtual Prepaid Card (Standalone, 1st Year Service Fee) amounting to 10 Lei, as these are included under the Card Consumer Terms and Conditions. Annual fees will be charged as normal from 2nd year onward.
6. Eligibility and Participation
The participation in the Okto Card Promo Offer is allowed to natural persons over 18 years of age that reside in Romania and who have already registered as OKTO Wallet Users pursuant to the OKTO Wallet Terms and Conditions and OKTO KYC/AML Levels and Limits.
Already holders of an Okto Card are not eligible to the Okto Card Promo Offer.
The Okto Card Promo Offer is going to run for a period of six (6) months however, OKTO retains its right to cease the promotional activity at any time or upon exhaustion of the budget of the Okto Card Promo Offer, without any compensation being due to any User or to any party or third party whatsoever.
To participate:
- You must be an OKTO Wallet User ;
- Complete successfully our Know Your Customer (KYC) check – Level 2 Premium pursuant to OKTO KYC/AML Levels and Limits, by providing OKTO with all necessary documentation.
- Accept “Paynovate Privacy Policy”
- Accept “Card Consumer Terms and Conditions”
- Complete the form related to the issuance of an OKTO Card.
7. Duration
The Okto Card Promo Offer will be available to the eligible Users from 1st of Match 2024 (12:00h UTC +1) (“Start Date”) until 1st of September 2024 (12:00h UTC +1).
8. Restrictions
As per the OKTO Wallet Terms and Conditions users are permitted to hold only one (1) OKTO Account. Multiple registrations are not permitted nor multiple Okto Cards are permitted.
You may be exempted only once of the Order Fee for Physical Prepaid Card (Order, Shipping, 1st Year Service Fee) and the Order Fee for the Virtual Prepaid Card (Standalone, 1st Year Service Fee).
OKTO reserves the right, at its sole discretion, to decline registration of any participation in the OKTO Card Promo Offer and/or disqualify any participant in this in case of tampering or attempt to tamper with the operation of the Okto Card Promo Offer (“Okto Card Promo Offer Abuse”).
Specifically, an Okto Card Promo Offer Abuse includes, but is not limited to:
i. breach of these Terms and Conditions and/or the OKTO Consumer Card Terms and Conditions and/or any of the OKTO Consumer Terms and Conditions set forth on the OKTO Website;
ii. request the exemption of the OKTO Card Promo Offer when already been once exempted;
Where there is a reasonable suspicion that the User has committed or attempted to commit an Abuse, either on their own or as part of a group, OKTO reserves the right to (cumulatively or selectively):
i. revoke, deny, or withdraw the OKTO Card Promo Offer from the User’s OKTO Account;
ii. exclude the User from any future promotional offer;
iii. terminate the User’s OKTO Account with immediate effect, according to the provisions of the OKTO Consumer Terms and Conditions.
Under no circumstances shall OKTO be liable for any consequences of the OKTO Card Promo Offer cancelation or decline.
The recipient of the Okto Card Promo Offer is responsible if any taxes result from this.
The Okto Card Promo Offer is not transferable, and it is provided as is, no substitutions are permitted and cannot be redeemed or exchanged for cash.
Any and all of OKTO’s decisions regarding any aspect of the Okto Card Promo Offer is final and binding, and no correspondence will be entered into about it.
9. Limitation of Liability
OKTO makes no representation or warranty in relation to the Okto Card Promo Offer. OKTO does not accept, to the fullest extent permitted by law, any liability for any damage, loss, injury or disappointment (including without limitation any loss of profits, loss of revenue, loss of goodwill) suffered by any User that arises out of or in connection with the Okto Card Promo Offer or as a result of either participating in the Okto Card Promo Offer, receiving the Okto Card or using the Okto Card.
If an act, omission, event or circumstance occurs which is beyond the reasonable control of OKTO and which prevent OKTO from complying with these terms and conditions, OKTO will not be liable for any failure to perform or delay in performing its obligations.
10. General
OKTO reserves the right to cancel, withdraw, terminate, or temporarily suspend this Okto Card Promo Offer or amend these Terms and Conditions at any time and/or in case of unavoidable circumstances beyond OKTO’s control that make it necessary. The Users will have access to any updated terms and conditions on the OKTO Website and/or will be notified via their registered e-mail address.
In the above cases, OKTO bears no responsibility towards the Users and the Users are not able to request the completion or continuation of the Okto Card Promo Offer and/or to claim damages.
If any of the above cases occur, any User that wishes communicate related to the Okto Card Promo Offer shall sent an e-mail to support@oktopayments.com, stating explicitly that it wishes to withdraw its participation. If the Users do not withdraw their participation by following the above procedure, their participation in the Okto Card Promo Offer will be considered valid, and it will imply that they tacitly and unconditionally accept the terms and conditions of the Okto Card Promo Offer, as these are amended.
The Okto Card Promo Offer and these Terms and Conditions shall be governed by the laws of Romania and any disputes will be subject to the exclusive jurisdiction of the Courts of Romania.
