Terms and Conditions of free prize competition

“Virtual Lucky Draw”

By entering this Prize Draw, you are agreeing to these Prize Draw terms and conditions.
The Prize Draw “Virtual Lucky Draw ” is being run by “OKTOPAY LIMITED” (hereinafter referred to as OKTO), based in Cyprus, 10 Mnasiadou and Strasikratous Street, P.C. 1065, Nicosia, Cyprus, with registration number HE400907 and it is part of the OKTO Business Rewards Programs.
By entering this Prize Draw, you are agreeing to participate also in the second OKTO Business Reward Program, namely “Gold Merchant”. In case you do not wish to enter in the “Gold Merchant” Free Prize Competition and/or you do not agree to the “Gold Merchant” Free Prize Competition terms and conditions, please do not enter this Prize Draw.
This Prize Draw is free to enter, and no purchase is necessary.

Eligibility to enter

The Prize Draw is open to any natural person over 18 years of age and any legal person, duly represented, and more specifically to:

Any natural or legal person who already offers the OKTO.WALLET SOLUTION* through the gaming machines provided by Regal Amusement Machine Sales Limited, and resides or maintains its business in the United Kingdom.

*The OKTO.WALLET SOLUTION is offered in the United Kingdom by Oktopay Limited in collaboration with Sureswipe EMI PLC, a company registered in Cyprus operating as a licensed e-money institution under the supervision of the Central Bank of Cyprus (authorization number 115.1.3.26) and approved to provide electronic money services under the freedom of provision of services within the EEE countries under the Electronic Money Directive and under the Temporary Permissions Regime in the United Kingdom (under FCA reference number 902821).

5. Duration

The Prize Draw will be conducted in two (2) periods.

The First Period starts on Monday 8th of November 2021 (00.00h UTC +1) (“Start Date”) and it will end on Monday 31st of January 2022 (23.59 UTC +1) (“Closing Date”).

The Second Period starts on Tuesday 1st of February 2022 (00.00h UTC +1) (“Start Date”) and it will end on Friday 30th of April 2022 (23.59 UTC +1) (“Closing Date”).

How to enter

To enter the Prize Draw:

The natural or legal persons need to register at the website oktowallet.eu/business-rewards with their full name, e-mail address, and the name of the legal entity by ticking “yes” to the relevant box. By registering, the entrants agree to be bound by these terms and conditions.
After the registration, a valid entry ticket for the draw will be issued every time an entrant’s customer/user completes a transaction equal or greater than five (5) GBP on the gaming machines using the WALLET SOLUTION.

Multiple entry tickets per registered email/entrant are permitted.

OKTO may disqualify any entrant whose entry does not comply with these terms and conditions (at OKTO’s discretion) or who, in OKTO’s sole determination, has acted in a manner that is fraudulent, dishonest, unjust to other entrants or in breach of these terms and conditions.

Winners & Prizes

The first working day after the Closing Date of the First and the Second Period of the Prize Draw, four (4) entry tickets will be chosen for each Period, from all the entry tickets issued during this Period. The four (4) winners of each Period will be selected by random virtual draw, though a Random Number Generator (RNG) that generates a sequence of numbers that cannot be reasonably predicted better than by a random chance.

Two of the winners of the First Period, selected randomly (“Golden Merchant”), will receive each a five hundred (500) GBP Amazon Gift Card and two of the winners of the First Period, selected randomly, (“Silver Merchant”) will receive each a two hundred and fifty (250) GBP Amazon Gift Card.

Two of the winners of the Second Period, selected randomly (“Golden Merchant”), will receive each a five hundred (500) GBP Amazon Gift Card and two of the winners of the Second Period, selected randomly (“Silver Merchant”), will receive each a two hundred and fifty (250) GBP Amazon Gift Card.

The prizes are non-exchangeable, non-transferable and no cash alternatives are available. OKTO will not take responsibility for any lost gift cards – replacements cannot be issued.

OKTO reserves the right to substitute the prize with another prize of equal or higher value if circumstances beyond OKTO’s control make it necessary to do so.

The decision of OKTO regarding any aspect of the Prize Draw is final and binding, and no correspondence will be entered into about it.

OKTO makes no representation or warranty in relation to the prize provided and, to the fullest extent permitted by law, OKTO shall have no liability in relation to the prize, its fitness for purpose, merchantability or otherwise.

Winner announcement

The winners will be announced in the OKTO website www.oktowallet.eu and the OKTO social media (facebook, Instagram, LinkedIn & twitter).

The winners will be also notified by e-mail, in the registered e-mail address, within 28 days after the Closing Date of each period.

OKTO may request the winners to participate in any publicity or promotion organized by OKTO including promotional photographs.

Receipt of the prize

Please allow 14 days for delivery of the prize or alternative collection or delivery arrangements may be made through mutual agreement. OKTO reserves the right to request proof of the winners’ identity in the form of a passport or driver’s license.

It is the responsibility of the entrant to provide correct, up-to-date details for the receipt of the prize and OKTO cannot be held responsible for the winner failing to supply accurate information which affects the delivery of the prize.

Any tax or other charges payable as a result of the receipt of the prize will be the responsibility of the winner. Winners should seek independent financial advice prior to receiving the prize if this is a concern.

Data Protection

OKTO will use the data submitted by entrants (full name and email address) only for the purposes of running the Prize Draw. By entering this Prize Draw, all entrants consent to the use of their personal data by OKTO for the purposes of the administration of this Prize Draw. The collection and use of the personal data of the entrants is governed by the Data Protection Act (2018) (DPA) and the General Data Protection Regulation 2016/679 (GDPR).

Specifically, OKTO, through its authorized employees, will process the personal data of the entrants, with a view to publishing the winners of the Prize Draw and delivering the prize.

In case the entrants did not consent to the use of their submitted data for other promotional purposes during their registration, their personal data, except for the personal data of the winners, will be destroyed one month after the Closing Date of the Second Period of the Prize Draw. The personal data of the winners will be deleted 12 months after the Closing Date of the Second Period of the Prize Draw. If the entrants did not consent to the use of their submitted data for other promotional purposes during their registration, their personal data will not be disclosed to third parties for other purposes not related to the Prize Draw.

OKTO will also publish the first name of the winner and the name of the legal entity on the OKTO Website www.oktowallet.eu and/or the OKTO Social Media (facebook, Instagram, LinkedIn & twitter) as appropriate, in order to announce the winner of the Prize Draw.

If you do not consent to such use of your details, please do not agree to take part in the Prize Draw.

All entrants may have their data removed by contacting OKTO via the e-mail address notifications@oktopay.eu. If the entrants’ data are removed prior the Closing date of either the First or Second Period of the Prize Draw, entrants will forfeit their right to claim any prizes.

Intellectual Property

By entering in this Prize Draw, the entrants gain no right whatsoever to the trademarks, brand names, logos and/or other OKTO intellectual property.

Limitation of Liability

OKTO does not accept any liability for any damage, loss, injury or disappointment (including without limitation any loss of profits, loss of revenue, loss of goodwill) suffered by any entrant that arises out of or in connection with the Prize Draw or as a result of either participating in the Prize Draw, winning the Prize Draw or using the prize, save that OKTO does not exclude its liability for death or personal injury as a result of its own negligence.

If an act, omission, event or circumstance occurs which is beyond the reasonable control of OKTO and which prevent OKTO from complying with these terms and conditions, OKTO will not be liable for any failure to perform or delay in performing its obligations.

General

OKTO reserves the right to cancel, withdraw, terminate, or temporarily suspend this Prize Draw or amend these terms and conditions at any time, in case of unavoidable circumstances beyond OKTO’s control that make it necessary and to the extent this would not be unfair or will not disadvantage those who sought to participate within the original terms. The entrants will be notified via the registered e-mail address.

In the above cases, OKTO bears no responsibility towards the entrants and the entrants are not able to request the completion or continuation of the Prize Draw and/or to claim damages.

If any of the above cases occur, any entrant that wishes to withdraw its participation in the Prize Draw shall sent an e-mail to notifications@oktopay.eu, stating explicitly that it wishes to withdraw its participation. If the entrants do not withdraw their participation by following the above procedure, their participation in the Prize Draw will be considered valid, and it will imply that they tacitly and unconditionally accept the terms and conditions of the Prize Draw, as these are amended.

If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

The Prize Draw and these terms and conditions shall be governed by and construed with the laws of England and any disputes will be subject to the exclusive jurisdiction of the Courts of England.

By entering this Prize Competition, you are agreeing to these Prize Competition terms and conditions.

5. How to enter

Duration

Please note that in case the OKTO.WALLET SOLUTION is not enabled for an entrant’s Location on the Start Date of this Prize Competition, the entrant is still eligible to enter in this Prize Competition and as Start Date for the said entrant will be considered the date when the OKTO.WALLET SOLUTION was enabled.

Winner

The winner will be announced based on the amount of the first transactions (first deposits), made by the entrants’ customers/users through the OKTO.WALLET SOLUTION in the gaming machines. The amount of first transactions will be calculated on a point-based system, where every first transaction (meaning every first time the OKTO.WALLET SOLUTION is used by a customer) will count as 100 points.

In order to calculate the total points, the points collected by each entrant will be divided by the number of active dates of the OKTO.WALLET SOLUTION (meaning the days since the date the OKTO.WALLET SOLUTION was enabled in the gaming machines).

The entrant that will have the most points on the Closing Date of the Prize Competition will be announced the winner.

The numerical data of the first transaction and the active dates of the OKTO.WALLET SOLUTION will be collected and transmitted to OKTO by RIMINI Systems Limited, through the Rimini Enterprise Software.

The prize

The winner will receive a 1,500 GBP Amazon Gift Card.

The prize is non-exchangeable, non-transferable and no cash alternatives are available. OKTO will not take responsibility for any lost Gift Cards – replacements cannot be issued.
