TERMS AND CONDITIONS

” WELCOME BONUS „

1. OKTO offers to the new users of the OKTO.WALLET (“Users”) a five GBP (£5) welcome bonus (“Welcome Bonus”).
2. These Welcome Bonus Terms and Conditions are subject to the OKTO Consumer Terms and Conditions,  OKTO KYC/AML Levels and Limits and the OKTO Privacy Policy set forth on the OKTO Website (www.oktowallet.eu).
3. Taking part in Welcome Bonus constitutes acceptance of these Welcome Bonus Terms and Conditions, OKTO KYC/AML Levels and Limits, OKTO Privacy Policy and of the OKTO Consumer Terms and Conditions set forth on the OKTO Website. If you do not agree to the above terms and conditions, please do not participate in the Welcome Bonus in any manner. Users should not participate in the Welcome Bonus where doing so would be prohibited by any applicable law or regulation.
4. The Welcome Bonus is offered by  Sureswipe EMI PLC, a company registered in Cyprus operating as a licensed e-money institution under the supervision of the Central Bank of Cyprus (authorization number 115.1.3.26) and approved to provide electronic money services under the freedom of provision of services within the EEE countries under the Electronic Money Directive and under the Temporary Permissions Regime in the United Kingdom, in collaboration with OKTOPAY LIMITED, a payments technology provider based in Cyprus, 10 Mnasiadou and Strasikratous Street, P.C. 1065, Nicosia, Cyprus, with registration number HE400907 (collectively referred to as “OKTO”).
5. The participation in the Welcome Bonus is free, and no purchase is necessary.
6. No part of the Welcome Bonus is directed to persons under the age of 18. IF YOU ARE UNDER 18 YEARS OF AGE, PLEASE DO NOT PARTICIPATE IN THE WELCOME BONUS AT ANY TIME OR IN ANY MANNER.

7. Eligibility

Subject to, and without prejudice to the OKTO Consumer Terms and Conditions set forth on the OKTO Website, the Welcome Bonus will be offered exclusively to the first one thousand (1,000) new users who will download the OKTO App,register and verify successfully in the KYC level 1 in the OKTO.Wallet from the Start Date of the Welcome Bonus, as this is described below.

The participation in the Welcome Bonus is allowed to natural persons over 18 years of age residing in the United Kingdom, who have been succesfully registered and verified as KYC Level 1 users in the OKTO App, according to the KYC AML/Levels and Limits requirements.

8. Duration

The Welcome Bonus will be available to the eligible Users from Monday 21st of June 2021 (00.00h UTC +1) (“Start Date”) until the completion of the first 1,000 new users who will receive the Welcome Bonus.

9. Participation process

To participate:

• Download the OKTO UK app on iOS or Android,
• Follow the on-screen instructions to register for an OKTO Account.
• Verify your identity, and
• Complete successfully our Know Your Customer (KYC) check – Level 1, by providing OKTO with all necessary documentation.

Users may opt-out from the Welcome Bonus if they wish. Please send your request at the following email address: support@oktopay.eu and the relevant department will process your request and inform you accordingly.

Users are permitted to hold only one (1) OKTO Account. Multiple registrations are not permitted nor multiple Welcome Bonus participations for the same OKTO Account.

OKTO reserves the right, at its sole discretion, to decline registration of any participation in the Welcome Bonus and/or disqualify any participant in the Welcome Bonus in case of tampering or attempt to tamper with the operation of the Welcome Bonus (“Welcome Bonus Abuse”).

Specifically, a Welcome Bonus Abuse includes, but is not limited to:

1. breach of these Welcome Bonus Terms and Conditions and/or any of the OKTO Consumer Terms and Conditions set forth on the OKTO Website;
2. the opening of multiple accounts to claim multiple Welcome Bonuses;

Where there is a reasonable suspicion that the User has committed or attempted to commit a Welcome Bonus Abuse, either on their own or as part of a group, OKTO reserves the right to (cumulatively or selectively):

1. forfeit the Welcome Bonus allocated to the User’s OKTO Account;
2. revoke, deny, or withdraw the Welcome Bonus from the User’s OKTO Account;
3. exclude the User from any future promotional offer;
4. terminate the User’s OKTO Account with immediate effect, according to the provisions of the OKTO Consumer Terms and Conditions.

Under no circumstances shall OKTO be liable for any consequences of the Welcome Bonus cancelation or decline.

10. Receiving Welcome Bonus

The Welcome Bonus will be credited to the User’s OKTO Account after the successful completion of the KYC check – Level 1, if he/she satisfies the eligibility requirements.

The Welcome Bonus can be used for payments in OKTO’S collaborating points in the United Kingdom, where the OKTO.WALLET SOLUTION is available. The Welcome Bonus is not available for peer to peer.

The Welcome Bonus is provided as is, no substitutions are permitted, and it may . Also, the Welcome Bonus is not transferable and may not be auctioned, traded, bartered or sold. Upon cancellation of the User’s OKTO Account in the OKTO.WALLET for any reason or upon withdrawal of the participation to the Welcome Bonus, the non-used Welcome Bonus will be forfeited. The Welcome Bonus will expire after the User’s OKTO Account has been inactive for 6 months and/or in case the User does not make use of the Welcome Bonus for a period of one (1) year.

All of OKTO’s decisions regarding any aspect of the Welcome Bonus is final and binding, and no correspondence will be entered into about it.

OKTO makes no representation or warranty in relation to the Welcome Bonus provided and, to the fullest extent permitted by law, OKTO shall have no liability in relation to the use of the Welcome Bonus.

11. Intellectual Property

By participating in this Welcome Bonus, the Users gain no right whatsoever to the trademarks, brand names, logos and/or other OKTO intellectual property.

12. Limitation of Liability

OKTO does not accept any liability for any damage, loss, injury or disappointment (including without limitation any loss of profits, loss of revenue, loss of goodwill) suffered by any User that arises out of or in connection with the Welcome Bonus or as a result of either participating in the Welcome Bonus, receiving the Welcome Bonus or using the Welcome Bonus, save that OKTO does not exclude its liability for death or personal injury as a result of its own negligence.

If an act, omission, event or circumstance occurs which is beyond the reasonable control of OKTO and which prevent OKTO from complying with these terms and conditions, OKTO will not be liable for any failure to perform or delay in performing its obligations.

13. Data Protection

The Welcome Bonus and the processing of User’s Personal Data for the purposes of the Welcome Bonus will be conducted according to the OKTO Privacy Policy set forth on the OKTO Website.

14. General

OKTO reserves the right to cancel, withdraw, terminate, or temporarily suspend this Welcome Bonus or amend these Terms and Conditions at any time, in case of unavoidable circumstances beyond OKTO’s control that make it necessary and to the extent this would not be unfair or will not disadvantage those who sought to participate within the original terms. The Users will be notified via the registered e-mail address.

In the above cases, OKTO bears no responsibility towards the Users and the Users are not able to request the completion or continuation of the Welcome Bonus and/or to claim damages.

If any of the above cases occur, any User that wishes to withdraw its participation in the Welcome Bonus shall sent an e-mail to support@oktopay.eu, stating explicitly that it wishes to withdraw its participation. If the users do not withdraw their participation by following the above procedure, their participation in the Welcome Bonus will be considered valid, and it will imply that they tacitly and unconditionally accept the terms and conditions of the Welcome Bonus, as these are amended.

If any of these clauses should be determined to be illegal, invalid, or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.

The Welcome Bonus and these Terms and Conditions shall be governed by and construed with the laws of England and any disputes will be subject to the exclusive jurisdiction of the Courts of England.
